1. Acceptance of Terms

By accessing or using upsonar.io ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

upsonar.io provides website monitoring services that check the availability, SSL certificate status, and performance of websites you specify. We offer both free and paid subscription plans with different features and limitations.

3. Account Registration

To use our Service, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Be at least 16 years of age
• Not share your account with others

You are responsible for all activities that occur under your account.

4. Acceptable Use

You agree NOT to use the Service to:

• Monitor websites without authorization from the website owner
• Conduct or facilitate any form of attack (DDoS, brute force, etc.)
• Attempt to probe or test vulnerabilities of third-party systems
• Violate any applicable laws or regulations
• Monitor illegal content or websites
• Exceed rate limits or abuse the monitoring infrastructure
• Resell or redistribute the Service without authorization

5. Subscription and Payments

For paid plans:

• Subscriptions are billed monthly or annually as selected
• Payments are processed securely through Stripe
• Prices may change with 30 days notice
• You can cancel your subscription at any time
• Subscriptions renew automatically each month or year until you cancel.
• You have a 14-day right of withdrawal from each payment; withdraw within 14 days and we refund it in full (14-day money-back guarantee).
• If you delete your account, payments from the last 14 days are refunded automatically. Older payments are not refunded; cancelling stops future renewals.

6. Service Availability

We strive to maintain high availability but do not guarantee 100% uptime. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any damages resulting from service interruptions.

7. Monitoring Accuracy

While we strive for accurate monitoring results, we cannot guarantee 100% accuracy. Monitoring results may be affected by network conditions, geographic routing, and other factors. The Service should be used as one tool among many in your monitoring strategy.

8. Intellectual Property

The Service, including its design, features, and content, is owned by upsonar.io and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UPSONAR.IO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

Nothing in these Terms limits liability for intent, gross negligence, death or personal injury, or your mandatory rights as a consumer.

10. Indemnification

You agree to indemnify and hold harmless upsonar.io from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

This section applies only to business users.

11. Termination

We may suspend or terminate your access for a serious or repeated breach of these Terms. We may also end the Service with 30 days' notice and refund the unused part of any prepaid plan. Upon termination, your right to use the Service will immediately cease.

You can delete your account at any time in Settings → Account. Deletion cancels your subscription immediately and erases your data as described in the Privacy Policy.

12. Changes to Terms

We email you at least 30 days before material changes take effect. If you don't accept them, you can cancel; we refund the unused part of a prepaid yearly plan.

13. Governing Law

These Terms are governed by the laws of the Republic of Cyprus. If you are a consumer, you also keep the protection of the mandatory laws of your country of residence and may bring claims in its courts; we may bring claims against a consumer only in the courts of their country of residence.
